GENERAL TERMS AND CONDITIONS


  1. Key Customer Information (Summary)
  2. 1. Your application shall be processed through licensed Spanish insurance agent/ intermediary.
  3. 2. iAssist does not underwrite or issue policies. Their role is limited to digital marketing and help in query resolution.
  4. 3. If application is accepted by insurer, then customer pays the premium directly to the insurer/ intermediary bank account
  5. 4. You have 14 days to withdraw, unless the policy has already started.
  6. 5. Policy cancellations due to Visa rejections may be refunded with appropriate documentation.
  7. 6. Data is processed as per GDPR
  8. 7. Refunds are subject to admin and payment gateway charges.

  9. Definitions

    For the purposes of these Terms and Conditions:

  10. iAssist refers to iAssist Innovations Labs Pte Ltd, a company incorporated in Singapore (UEN: 202223286W), operating as a digital marketing and technology services platform.
  11. Licensed Insurance Distributor refers to an individual and/or entity authorised and registered in Spain to distribute insurance products in accordance with applicable regulations.
  12. Customer refers to any natural person using the platform for purposes not primarily related to their trade, business, or profession.
  13. Insurance Provider means the insurer underwriting the policy, selected and contracted by the customer.
  14. Service Fee means the partially refundable amount payable to iAssist (as set out in Section 4.2) for application support, query resolution and connection to the Licensed Distributor.
  15. Insurance Premium means the amount payable directly by the Customer to the licensed Distributor or insurer for the insurance cover, which iAssist does not collect.
  16. Website means https://spinsure.iAssist.com/spainhealth/travel-insure and any successor URL.

  17. 1. Scope of application
  18. Unless otherwise specified, these General Terms and Conditions of iAssist Innovations Labs Pte Ltd (hereinafter referred to as "iAssist") apply to all offers made by IAssist for the application of travel assistance products and health plans listed of licensed partners on the online purchase website  https://spinsure.iAssistgo.com/spainhealth/travel-insure (hereinafter referred to as "online application"). The customer has the opportunity to carry out an independent and free comparison of certain health insurance and travel assistance products from different insurance companies and to submit insurance applications online. These General Terms and Conditions apply exclusively if the customer is a consumer. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.

    iAssist operates solely as a technology and marketing service provider for licensed insurance intermediaries in Spain. We do not broker, underwrite, or administer insurance policies, nor we guarantee acceptance of any application. All insurance contracts are concluded directly between the customer and the licensed intermediary/insurer. iAssist bears no liability for policy performance, claims, or disputes. Travel assistance and insurance products are separately offered by licensed intermediaries. For any regulation or license requirement please do write to the licensed intermediaries. In event of a claim or any dispute, customer need to contact the service provider directly.

  21. 3.Role of iAssist & Licensed Distribution Partners
  22. iAssist does not underwrite, issue or administer any insurance product, nor does it offer insurance advice. iAssist acts solely as a digital marketing and application‑support service provider for licensed Spanish insurance intermediaries (“Licensed Distributor”). All insurance applications, premium payments, policy documentation, claims handling and product advice are provided exclusively by the Licensed Distributor or the underwriter. Customers contract directly with the Licensed Distributor under that intermediary’s own terms, conditions, and regulatory permissions.

  23. 4.Insurance Contract
  24. 1. The customer is guided through the online application process. iAssist provides the customer with free and non-binding information about rates and conditions provided by the licensed intermediaries working with iAssist for travel & health insurance.
  25. 2. iAssist uses the online application portal to provide health insurance solutions along with additional services for travel assistance, digital marketing for international travel, and allied businesses.
  26. 3. As soon as the customer has selected the health insurance in Spain, they can initiate the application process with the selected provider by clicking on the pay button. Upon successful payment, the contract is concluded with iAssist for application support, coverage explanation, query resolution, and connecting with the appropriate licensed intermediary.
  27. 4. iAssist will help the customer fill the Spain health insurance application form, which shall be further sent to the licensed intermediary of the insurance company in Spain.
  28. 5. The respective insurance company alone shall decide whether to accept an insurance application from the customer. If the proposal form is approved, then the customer will be prompted to pay 100% of the insurance premium directly to the insurer or their licensed intermediary's bank account. The customer directly contracts with the respective licensed insurance partner per their terms.
  29. 6. The language available for the conclusion of health insurance in Spain will be Spanish.
  30. 7. Before the customer clicks to pay the amount, the details must be checked and, if necessary, corrected. The customer must ensure that all necessary information fields and personal details, as well as contact details, are filled in carefully and correctly—especially regarding the correct spelling and indication of the date/month (as per product coverage) for the required insurance policy and travel period.
  31. 8. There may be restrictions on changing the insurance period, and the customer is encouraged to carefully read all policy terms and conditions.
  32. 9. After payment of the service fees, the customer will receive an application form which must be filled and sent to yash.parashari@iail.in and the licensed distributors. Insurers will evaluate the application and, if acceptable, they will indicate the premium to the customer.
  33. 10. Upon paying the premium, the insurer may take 5–15 days to issue the insurance contract to the customer.
  34. 11. iAssist stores the online contract data for coordinating with the licensed insurance partners. After the conclusion of the contract, the customer receives confirmation including the insurance policy, general terms and conditions, insurance conditions, and consumer information from the respective insurance company by email.
  35. 12. After the policy decision, iAssist deletes all personal identifiable information of the customer. The only information that will be stored includes: Application Number/Date, Insured Name, Passport Number, Region, Cover Start/End Dates, and Premium Payment Details.
  36. 13. iAssist provides digital marketing services to licensed Spanish intermediaries. All insurance applications, payments, and contracts are managed directly by the licensed intermediary (not iAssist).

  37. Payment, Prices and Invoicing
  38. 1. Service fees payment is made via Stripe which supports multiple currencies like Mastercard, Visa, American Express etc. You may refer to all currencies accepted at stripe.com to access the most updated list.
  39. 2. Payment Structure
    1. 1. Service Fee: Customers pay iAssist a non-refundable fee (€200 + 5% of insurer cost) for application support, coverage explanation, queries resolution, and connecting with the appropriate licensed intermediary authorized for placement of the local health insurance policy.
    2. 2. Insurance Premiums: Paid directly to the licensed intermediary/insurer to their bank account after acceptance of the proposal form. iAssist does not collect, hold, or transfer premiums.
    3. 3. If your insurance application is rejected by the licensed distributor or insurer, we will refund the service fee minus:
      • -Stripe payment‑gateway charges
      • -Administrative charge of €50 per applicant

    4. Note: Premiums are never collected by iAssist and are not refundable by us.

  40. 3. When paying via the payment methods mentioned below, the purchase price claim is transferred to Stripe Payment Europe Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210 Ireland as payment processor operating for iAssist Innovations Labs. The data required for payment processing will be transferred to Stripe Payments Europe, Limited. The provision of the data is necessary for the conclusion of the contract. Failure to provide the data means that the contract cannot be concluded. Further information can be found in the data protection provisions of the payment service provider (https://stripe.com/de-en /privacy).
    4. All prices are in Euros and incl. taxes.
    5. No contradictory national laws

    The customer warrants that he is entitled to take out health insurance outside home country abroad in accordance with the local laws of his home country. iAssist is not liable for the review of the customer’s national laws and any resulting claims.

    Insurance products are not available to residents of:

    1.Countries under EU/U.S. sanctions (e.g., Russia, Iran).

    2. Jurisdictions where local laws prohibit cross-border insurance.

    3. Our licensed partners reserves the right to cancel policies violating this clause.

    6. Anti‑Money Laundering & Know‑Your‑Customer

    The licensed distributor/ insurer is responsible for all AML/KYC checks required by Spanish law. iAssist does not perform AML or KYC checks on your insurance application or premium payment. For questions about these checks, please contact the Licensed Distributor directly.

    7. Product Pricing

    iAssist endeavours to ensure that the information on the insurance companies' rates and conditions are always up to date, complete and correct. However, the information is provided without guarantee and customer shall make independent assessment of insurance company risks.

    8. Rejected Application

    The customer may cancel this contract as detailed in the policy terms and conditions. The customer must contact iAssist in writing by email at info@crestglobal.in. If a customer’s visa application is formally rejected by the Spanish consulate/embassy, the customer may request a cancellation and refund in writing by email to info@crestglobal.in within 10 days of the official notice. The customer must attach an official visa rejection letter. iAssist will coordinate with the licensed distributor to process a cancellation request, subject to the insurer's approval.

    Upon approval, the customer will receive a refund of the premium amount paid, minus payment processing charges currently set at 3.5% + EUR 0.29, + Euro 50 per applicant, and excluding any non-refundable services already consumed (e.g. issued visa letters, translations, add-ons). Refunds are processed within 10 business days of confirmation.

    If the Licensed Distributor or insurer rejects your insurance application, you may request a refund of your Service Fee only (Please note - Insurance Premiums are never held by iAssist).

    To request, email info@crestglobal.in with your application number and official rejection notice within 10 days of such decision.

    We will refund the Service Fee minus: (i) Stripe gateway fees; (ii) €50 administrative charge per applicant; within 10 business days of receipt.

    9. Liability of iAssist

    1. In so far as the liability of iAssist is excluded or limited, this also applies to the personal liability of legal representatives, employees and vicarious agents of iAssist.

    2. iAssist shall not be liable for the accuracy of insurance coverage, product suitability, rejection of applications, visa denials, or any claim decisions made by the insurer. iAssist is not responsible for verifying the legal eligibility of the customer to purchase insurance products abroad. Liability is limited to direct damages caused by gross negligence or wilful misconduct by iAssist, and in any case, shall not exceed the service fee charged for the transaction. iAssist shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits or reputational damage.

    3. Any liability arising due to insurance contract servicing, performance, claims handling, query resolution etc shall be between customer and insurer along with the licensed intermediary. By using this online application, the customer agrees to hold iAssist harmless from any such liabilities arising due to any negligence or service delivery.

    10. Links to third party websites

    The website may contain hyperlinks to websites operated by third parties (e.g. insurance companies). Such hyperlinks are provided to the customer for information purposes only and iAssist is not responsible for their content.

    11. Data Protection

    Roles & Legal Basis

    iAssist acts as a Data Processor under instruction of the Licensed Distributor (the Data Controller) for all personal data you submit via our platform.

    We process your data only to: (a) facilitate your insurance application; (b) provide the services you’ve ordered; and (c) comply with legal obligations.

    The Controller’s legal basis for processing is Article 6(1)(b) GDPR (performance of contract).

    International Transfers & Safeguards

    Our registered office is in Singapore, which the European Commission regards as a “third country.” Personal data may be transferred there under the Standard Contractual Clauses approved by the European Commission.

    By accepting these Terms, you consent to the transfer of your personal data outside the EEA under those safeguards.

    Your Rights

    You have the right to:

    1. Access and receive a copy of your data;

    2. Rectify inaccurate or incomplete data;

    3. Erase data where there is no overriding legal basis to retain it;

    4. Restrict or object to processing;

    To exercise any right, email our DPO at dpo@crestinsuretech.in. We will respond within one month, for complex requests.

    Data Retention

    Temporary application data (forms, supporting docs): deleted within 30 days of policy issuance or rejection.

    Contractual reference data (application ID, dates, service‑fee invoice): retained for 3 years (EU record‑keeping requirement), then securely deleted or anonymised.

    12. Force Majeure

    iAssist shall not be liable for any delay or failure to perform its services under these Terms if such delay or failure is due to events beyond its reasonable control (e.g., natural disasters, strikes, cyber‑attacks, pandemic measures, government actions).

    13. Amendments

    iAssist may update these Terms at any time. We will notify you of material changes by email or via a notice on our website at least 14 days before they become effective. Continued use of our services after the effective date constitutes acceptance of the revised Terms.

    14. Applicable law, note on participation in disputes, severability clause

    1. All disputes related to insurance distribution (including quotes, coverage, service deficiency, payments, or claims) are governed by Spanish law, with exclusive jurisdiction in Madrid courts and shall be directed to a licensed intermediary. Indian law applies only to disputes over iAssist’s assistance services.

    2. At the time of purchase of the contract for the first time via this online application, for customers located within the European Union, these Terms and Conditions shall be governed by the laws of Spain, without prejudice to any mandatory consumer protection laws of the customer’s home country.

    3. For all other conditions, the Terms shall be governed by the laws of the Republic of India.

    4. In the event of a dispute, the competent courts of Spain shall have jurisdiction for EU customers, while non-EU users agree to submit to the exclusive jurisdiction of the courts of India, as applicable.

    5. If any provision is found invalid, the remainder of the Terms shall remain in full effect. Invalid provisions shall be interpreted to reflect the original intent as closely as possible.

    6. Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of these General Terms and Conditions. Invalid provisions shall be reinterpreted in such a way that the economic purpose intended by this provision is achieved.

    15. Miscellaneous Clause

    1. No Advice

    iAssist does not provide insurance advice.

    Customers must consult the licensed intermediary for policy suitability.

    Their details are provided in the online application.

    2. iAssist’s Fees

    Are strictly for services as detailed in the contract earlier, calculated as 5% of cost plus Euro 200.

    Customers receive a separate invoice for iAssist’s fees at the time of making payment to iAssist.

    3. Policy Accuracy

    Premium quotes are estimates only. Final pricing is determined by the insurer post-application based on customer risk profile.

    4. Claims Liability

    iAssist is not involved in claims processing for these policies. Disputes must be directed to the insurer/licensed intermediary.

    5. Right of Withdrawal

    In accordance with applicable consumer protection laws in the EU, customers purchasing insurance contracts online may withdraw from the insurance application within 14 calendar days from the date of purchase, without stating any reason, provided the insurance coverage has not yet commenced or no claims have been made.

    In cases where the customer has expressly requested immediate commencement of insurance coverage during the withdrawal period, and coverage has started, a pro-rata premium may be deducted. All decisions shall be made by licensed distributor and their insurer. In event of any dispute, customer shall write to the insurer or licensed distributor directly.

    To withdraw, send a written notice (including your name, application number, and bank details for refund) to info@crestglobal.in. We will refund the service fee minus any (i) payment‑gateway charges, (ii) admin fees for processing the application and (iii) proportional fees for services already rendered, within 14 days of receiving your notice.

    6. Cookies & Tracking

    Our website uses cookies and similar technologies (e.g. Google Analytics) to understand site performance and target marketing. You may accept or reject non‑essential cookies via the banner at first visit. Declining cookies will not prevent you from using the core application‑support services.

    7. Entire Agreement

    These Terms (together with any documents expressly referred to) constitute the entire agreement between you and iAssist in relation to our services and supersede all prior statements, understandings and agreements.

    8. No Reliance

    You acknowledge that, in agreeing to these Terms, you have not relied on any oral or written representations other than those expressly set out herein.

    9. Notices

    All notices under these Terms must be in writing and sent to:

    - Customer: the email address you provide on application.

    Notices are deemed received 2 business days after sending.

    10. Assignment

    You may not assign, novate or otherwise transfer any of your rights or obligations under these Terms without iAssist’s prior written consent. iAssist may assign these Terms to any affiliate or successor.
